Section 1: Designated Contact
Hearts 4 Paws will serve as the designated point of contact for the Foster at Hearts 4 Paws. The Foster agrees to communicate with their designated Hearts 4 Paws representative regarding the care and fostering of the Pet.
Section 2: Appointment Coordination
The Foster is responsible for coordinating and scheduling all medical, veterinary, or grooming appointments for the Pet through Hearts 4 Paws. The Foster shall transport the Pet to and from appointments unless otherwise arranged. If the Pet is not spayed or neutered by the Foster Date, the Foster must arrange, through Hearts 4 Paws, for the Pet's spaying or neutering at one of Hearts 4 Paws' approved veterinary partners. Breeding the Pet is prohibited. The Foster shall promptly notify Hearts 4 Paws of the Pet’s injury, illness, or death during the foster care period.
Section 3: Food & Supplies
Hearts 4 Paws will provide the Foster with necessary food and supplies for the Pet during the foster care term. If the Foster chooses to purchase food, supplies, or items related to the Pet's care, such expenses shall not be reimbursed by Hearts 4 Paws. Advance notice to Hearts 4 Paws is required for expected supplies or food needed.
Section 4: Marketing Assistance
Hearts 4 Paws markets adoptable pets through various channels. The Foster is expected to assist in marketing the Pet for permanent adoption. This may include attending adoption events, providing photos and descriptions, and promoting the Pet through word of mouth and other means.
Section 5: Foster Commitment
The Foster understands that the duration of the foster period is variable, potentially spanning weeks or months. The Foster commits to fostering the Pet for the necessary duration. If the Foster can no longer care for the Pet, they shall notify Hearts 4 Paws and actively seek a suitable foster or adoptive home. Hearts 4 Paws retains ownership of the Pet during the foster period and can reclaim it as needed.
Section 6: Option to Adopt
Fosters have the first option to adopt the Pet. However, adoptions require sterilization, payment of the adoption fee, and signing a written registration contract.
Section 7: Assumption of Risk
The Foster acknowledges inherent risks and uncertainties related to caring for the Pet. These risks include injury to persons or property. The Foster voluntarily assumes responsibility for these risks. Hearts 4 Paws and its affiliates are released from claims, losses, liabilities, injuries, or damages arising from the Pet's care. This includes bodily injury or property damage claims.
Section 8: Indemnification
The Foster agrees to be solely responsible for the Pet's actions and to indemnify and hold Hearts 4 Paws and its associates harmless from liabilities, injuries, losses, or claims caused by the Pet. This covers actions, claims, suits, or demands arising from such occurrences.
Section 9: No Warranties
The Foster acknowledges that Hearts 4 Paws makes no guarantees, promises, or warranties regarding the Pet's disposition, health, or personality. The Foster accepts the Pet "as is" with any faults.
Section 10: Entire Agreement
This Contract constitutes the full agreement between the parties and supersedes prior agreements. It outlines that no other understandings, agreements, or warranties are valid unless in writing and signed by both parties.
Section 11: Governing Law and Disputes
The enforcement and interpretation of this Contract are governed by Utah law. Unresolved disputes shall be submitted to binding arbitration, with details specified.
Section 12: Future Fosters
This Contract is binding for all current and future pets under the Foster's care on behalf of Hearts 4 Paws.
